Terms of Service

Cratecode LLC ("Cratecode", "we", "our", or "us") operates the website https://cratecode.com (the "Site"), which provides an online learning platform that allows users to upload, view, and fork ("fork" means to create a new copy on the platform) lessons ("Lessons"). By using Cratecode, you agree to these Terms of Service. If you do not agree to these Terms of Service, you may not use Cratecode.

We may modify these Terms of Service at any time without prior notice. By using Cratecode after any such modification, you agree to be bound by the modified Terms of Service.

1. User Content

1.1. User Content Definition

For the purposes of these Terms of Service, "User Content" refers to any content submitted by users to Cratecode, including but not limited to Projects, Lessons, Comments, and Feedback.

1.2. Uploading User Content

By uploading a Lesson, Project, Comment, or Feedback ("User Content") to Cratecode, you represent that:

  • You have the right to upload the User Content to Cratecode and to grant the rights granted in these Terms of Service.
  • The User Content does not infringe the intellectual property rights or other rights of any other person or entity.
  • The User Content does not contain any viruses, Trojan horses, worms, time bombs, cancelbots or other computer programming routines that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information.
  • The User Content is not obscene, libelous, defamatory, threatening, harassing, hateful, racially or ethnically offensive, or otherwise objectionable.
  • The User Content does not encourage conduct that would violate any law or that would give rise to civil liability.

Please note that any information put into a project, lesson, comment, or feedback may be made public, and users are responsible for ensuring that any data submitted is appropriate for public sharing.

1.3. License

When you upload or fork a Project or Lesson, or submit Comments or Feedback ("User Content") on Cratecode, you grant Cratecode and its users a non-exclusive, royalty-free, perpetual, irrevocable, worldwide license to (i) copy, distribute, modify, and publicly display that User Content, and (ii) sublicense these same rights to anyone, for any purpose, commercial or non-commercial. You also grant Cratecode the right to use your name, username, nickname, and profile picture in connection with that User Content and waive any rights of privacy or publicity to the extent permissible under applicable law. If you delete User Content from Cratecode, we will remove the original copy from our records and stop distributing the original copy, but users who have already forked Projects or Lessons may continue to do so.

2. User Conduct

By using Cratecode, you agree not to:

  • Use Cratecode for any illegal purpose.
  • Upload any User Content that you do not have the right to upload or that contains viruses, Trojan horses, worms, time bombs, cancelbots or other computer programming routines that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information.
  • Interfere with or damage Cratecode or any network connected to Cratecode.
  • Use any robot, spider, site search/retrieval application, or other device to retrieve or index any portion of Cratecode.
  • Collect any personally identifiable information from Cratecode.
  • Reformat or frame any portion of Cratecode.
  • Create user accounts by automated means or under false or misleading pretenses.
  • Engage in spamming, phishing, pharming, or Denial of Service (DoS) attacks.
  • Transmit any viruses, worms, defects, Trojan horses, or any items of a destructive nature.
  • Misrepresent your affiliation with any person or entity.
  • Use Cratecode to violate the security of any computer network, crack passwords or security encryption codes, or transfer or store illegal material. This includes, but is not limited to, copyrighted material, material we judge to be threatening or obscene, or material protected by trade secret.

3. User Information

We collect the following information about you when you use Cratecode:

  • Your name, email address, and profile image if you choose to register for an account.
  • Your account ID if you choose to register through an OAuth2 platform including, but not limited to, Google, LinkedIn, or GitHub.
  • Your IP address.
  • Information about your use of Cratecode, including, but not limited to, the lessons you viewed, the date and time you viewed them, and the amount of time you spent on each lesson.
  • Any and all User Content (including Projects, Lessons, Comments, and Feedback) that you upload to Cratecode, both through the website and the API.

We use this information to provide, improve, and protect Cratecode. We will never sell your personally identifiable information to a third party without your consent.

4. Third-Party Services

Cratecode may contain links to third-party websites or services. We do not control and are not responsible for these services, including their content, data policies, or practices. Your use of third-party services is at your own risk.

5. Security

We take security seriously, but no website is completely secure. We cannot guarantee that information you provide to us will not be intercepted while being transmitted to us. We urge you to take steps to keep your information safe when using Cratecode, including using a secure browser and not sharing your Cratecode password with anyone.

6. Disclaimer of Warranties

CRATECODE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE SPECIFICALLY DISCLAIM ANY AND ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO: (A) ANY WARRANTIES CONCERNING THE AVAILABILITY, ACCURACY, USEFULNESS, OR CONTENT OF INFORMATION, PRODUCTS OR SERVICES; AND (B) ANY WARRANTIES OF TITLE, WARRANTY OF NON-INFRINGEMENT, WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. THIS DISCLAIMER OF LIABILITY APPLIES TO ANY DAMAGES OR INJURY CAUSED BY ANY FAILURE OF PERFORMANCE, ERROR, OMISSION, INTERRUPTION, DELETION, DEFECT, DELAY IN OPERATION OR TRANSMISSION, COMPUTER VIRUS, COMMUNICATION LINE FAILURE, THEFT OR DESTRUCTION OR UNAUTHORIZED ACCESS TO, ALTERATION OF, OR USE OF RECORD, WHETHER FOR BREACH OF CONTRACT, TORTIOUS BEHAVIOR, NEGLIGENCE, OR UNDER ANY OTHER CAUSE OF ACTION. NEITHER WE NOR ANY OF OUR AFFILIATES OR LICENSORS WILL BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY OR CONSEQUENTIAL DAMAGES IN CONNECTION WITH CRATECODE OR THE USE THEREOF, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

7. Indemnity

You agree to indemnify, hold harmless and defend Cratecode, its affiliates and licensors, and each of their respective officers, directors, employees, attorneys and agents (collectively, the "Released Parties") from and against any claims, actions, demands, liabilities, damages, losses, and expenses, including without limitation reasonable attorney's fees and costs, arising out of or in any way connected with: (i) your breach of these Terms of Service; (ii) your User Content; or (iii) your use of Cratecode.

8. Termination

We may terminate your access to and use of Cratecode at any time, with or without cause, with or without notice. Upon any such termination, your right to access and use Cratecode will immediately cease. If you wish to terminate your account, you may do so by accessing the "Delete Account" tab inside of the "Account" page (https://cratecode.com/account). All provisions of these Terms of Service which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

9. Copyright Complaints

We respect the intellectual property rights of others and we expect our users to do the same. If you believe that your work has been copied in a way that constitutes copyright infringement, please provide our copyright agent with the following information:

  • An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest;
  • A description of the copyrighted work that you claim has been infringed;
  • A description of where the material that you claim is infringing is located on Cratecode;
  • Your address, telephone number, and email address;
  • A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and
  • A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

10. General Terms

  • These Terms of Service and any action related thereto will be governed by the laws of the State of Washington without regard to its conflict of law provisions.
  • You agree that any claim or dispute you may have against Cratecode must be resolved exclusively by a state or federal court located in Seattle, Washington.
  • You agree to submit to the personal jurisdiction of the courts located in Seattle, Washington for the purpose of litigating all such claims or disputes.
  • If any provision of these Terms of Service is found to be unlawful, void, or for any reason unenforceable, then that provision will be deemed severable from these Terms of Service and will not affect the validity and enforceability of any remaining provisions.
  • These Terms of Service constitute the entire agreement between you and Cratecode with respect to Cratecode, and supersedes all prior or contemporaneous communications and proposals (whether oral, written, or electronic) between you and Cratecode with respect to Cratecode.
  • A waiver by either party of any term or condition of these Terms of Service or any breach thereof, in any one instance, shall not waive such term or condition or any subsequent breach thereof.
  • You may not assign, transfer or sublicense any or all of your rights or obligations under these Terms of Service without our express prior written consent. We may assign, transfer or sublicense any or all of our rights or obligations under these Terms of Service without your express prior written consent.
  • Notices to you (including notices of changes to these Terms of Service) may be made by email, regular mail, or postings on Cratecode.
  • These Terms of Service do not confer any third-party beneficiary rights.
  • We reserve all rights not expressly granted to you.
  • You acknowledge and agree that Cratecode may establish general practices and limits concerning use of Cratecode, including without limitation the maximum number of days that User Content will be retained by Cratecode, the maximum storage space that will be allotted on Cratecode's servers on your behalf, and the maximum number of times (and the maximum duration for which) you may access Cratecode in a given period of time. We reserve the right to delete any User Content that we determine, in our sole discretion, not to be in compliance with these Terms of Service or to be otherwise objectionable. We reserve the right to change these general practices and limits at any time, in our sole discretion, with or without notice.
